1. INTRODUCTION

This Privacy Policy (“Privacy Policy”) explains how we gather, use and protect any personal information from and about you that you give to us when you use our Services. We are committed to ensuring that your privacy is protected and we try to keep the amount of personal information we request to a minimum at all times. Should we ask you to provide certain information by which you can be identified when our Services, then you can be assured that it will only be used in accordance with this Privacy Policy.

Any data that's shared with us is used only to deliver an expected service. We seek your consent to the processing of information about you. Consent for the purpose in which you supply your data will be determined by the situation in which you give this information. For example, if you register with us, you will necessarily be supplying us with information which we can use to identify you for future logins. However, in respect of using your personal information for the purposes of direct marketing, or sharing your data with others, we will give you the choice of opting out. If you choose to opt out of such communication we will hold information showing that you have made this choice.

By accessing or using the Services, you (“you”, “your”) acknowledge and confirm that you have read, understand, are comfortable with and accept this Privacy Policy.

2. WHAT DATA DO WE COLLECT

In order for Services to function, we need to collect and process data and/or information about you and your professional involvement that directly or indirectly identify you (“Personal Data”).

  • Order information, such as the memberships you purchase, date and amount of the order;

  • Information from and on your visit to and use of our Services (your web request, Internet Protocol address, browser type and settings, referring / exit pages and URLs, number of clicks and how you interact with links on the Services, metadata associated with uploaded Content, domain names, landing pages, pages viewed, date and time stamp information and other such information)
  • Content of requests for data, products or services
  • Content of your responses to requests for data, products or services
  • Content of your material research data contributions
  • Content of your communication with MATDAT
  • Content of your communication with customer support

3. HOW DO WE COLLECT YOUR DATA

3.1 Data You Directly Provide To Us

You directly provide MATDAT with most of the data we collect. We collect and process Personal Data when you:

  • register online to create a Member account or place an order for any of our Membership Services
  • contact us and place an off-line order for our Membership Services
  • create a profile in order to showcase and promote your’s or your organization’s products and services
  • provide, post or upload content or information to our Services
  • post a request for data, products or services to our Services
  • respond to a request for data, products or services published on our Services
  • email or write to us
  • subscribe to receive our newsletter or other information from us that is of interest to you
  • use our Customer Support

3.2 Data We Receive Indirectly

We may also receive Personal Data indirectly in number of ways or from different sources which include:

  • servers automatically record certain information in server logs when you use our website and Services
  • Google Analytics, a web analytics service operated by Google, Inc., California, USA
  • others may post content that includes information about you as part of profiles on our Services
  • third party partners providing us information about you and your activities on and off the Service such as information from advertisers about your experience or interactions with them or when you create or respond to requests for data, products or services on our system.

4. HOW WILL WE USE YOUR DATA

4.1 Using Your Personal Data

By using we mean the collection, recording, organisation, storage, adaptation or alteration, retrieval, consultation, use, disclosure by forwarding, dissemination or otherwise making available, combining, blocking, erasure or destruction of your personal data.

We use your Personal Data so that we can:

  • provide and deliver our Services to you
  • manage your registration and account
  • process your orders and purchases
  • communicate with you
  • provide Customer Support
  • inform you about requests for data, products ans services posted at our Services
  • develop and improve our Services
  • periodically send newsletters, promotional or marketing materials and other information about our Services and new products, special offers or other information which we think you may find interesting
  • contact you for market research purposes from time to time
  • customise the website and services according to your interests
  • ensure legal usage of our Services according to Terms of Service and corresponding Membership Agreement(s)
  • generate anonymized aggregated statistics about usage of our Services

4.2 Legal Basis for Processing

We use your Personal Data, on one or more of the following legal grounds: (i) because processing is necessary to perform a contract with you, such as to deliver the MATDAT Services; (ii) to comply with our legal obligations; (iii) because processing is necessary for purposes of our legitimate interest or those of any third party recipients that receive your Personal Data, provided that such interests are not overridden by your interests or fundamental rights and freedoms. We may also process your data based on your consent where you have expressly given that to us.

4.3 Sharing Your Personal Data

We do not share the Personal Data collected - or provided by you - with third parties unless we have obtained your prior consent. However, we reserve the right to provide access to or share the Personal Data we have about you with select third parties who perform services on our behalf and help us in providing benefits to you. Before using third-party tools and/or services for any use listed above, we make sure those third parties are privacy compliant and we have apropriate agreements in place with such third parties.

Currently, we are using following third-party products/services:

  • Mailchimp - for periodically sending newsletters and other similar communication by e-mail
  • Less Annoying CRM - for managing contacts and accounts
  • Fastspring - for performing sales and billing
  • tawk.to - chat and support service

We may also share Personal Data in response to legal process or when the law requires it (for example, in response to a court order) or, to the extent permitted by applicable law, to protect the rights, property or safety of MATDAT, the Services, Users of the Services (including you), and others. MATDAT may also disclose Personal Data as is necessary to identify, contact, or bring legal action against a person or entity who may be violating MATDAT’s Terms of Service, or Membership Agreement(s) or who may be causing harm to, or interfering with, other Users of the Service.

In the event that assets of MATDAT are transferred or sold to another entity, Personal Data may be transferred to the acquiring entity and/or to potential acquiring entities to the extent permitted by applicable law and we will seek your consent where required.

Our Services are a dynamic, innovative environment, which means we are always seeking to improve our offer to you. We may introduce material new features, which may result in the collection of new information or new ways of collecting or sharing your personal data; if we do so, we will inform you by updating this Privacy Policy.

5. HOW DO WE SECURE AND STORE YOUR DATA

We are taking steps reasonably necessary to ensure your Personal Information is treated securely and in accordance with this Privacy Policy and applicable law. We use appropriate security measures (need-to-know basis, security software such as a virus scanner and firewall, passwords for electronic systems, a secure internet connection, backups and encryption to protect against unauthorized access, collection, use, disclosure, copying, and disposal of your Personal Information.

All pages of our Services are secured using SSL (Secure Socket Layer) technology, which encrypts data between our computer and your end devices. To make sure your Internet browser is using the latest security features, you may want to download the most recent version of it, which should have full SSL support. However, no method of transmission over the Internet, and no means of electronic or physical storage, is absolutely secure, and thus we cannot ensure or warrant the security of that information.

Your Personal Data is stored at the location of our offices in Croatia and at a location of our servers in Netherland. We do not store your Personal Data longer than is strictly necessary for carrying out the uses.

Personal data related to dormant or abandoned user accounts are deleted 10 years after the last access or use of that user account. Personal data related to deleted user accounts are deleted 30 days after account deletion. Even after deletion from our system, certain Personal Data may remain present in backup copies of our data for certain period of time. Such data will not be used anymore and will eventually be deleted in accordance with our backup practice and policy. If there are legal requirements applicable to the storage, the personal data are stored no longer than required by law.

6. MARKETING AND SITES AND SERVICES OF OTHERS

We would like to be able to send you information about products and services of ours that we think you might like, as well as those of our partner companies but will always ask you for your permision. If you have agreed to receive marketing, you may always opt out at a later date.

We may have advertising and links to other websites on our Services but we do not share your Personal Data with third-party advertisers for their direct marketing purposes unless you give us your prior consent.

After clicking on a third-party advertisement or link, you may no longer be on a site hosted by MATDAT. Our Privacy Policy applies only to MATDAT website and Services. If you click on a link which is taking you to another website, you should read their privacy policy first.

7. YOUR DATA PROTECTION RIGHTS

We would like to make sure you are fully aware of all of your data protection rights. You and every User is entitled to the following:

The right to access - You have the right to request from us copies of your Personal Data. We may charge you a small fee for this service.

The right to rectification - You have the right to request that we correct any information you believe is inaccurate and to complete information you believe is incomplete.

The right to erasure - You have the right to request that we erase your Personal Data, under certain conditions. For this purpose, you may use our “Right to Erasure - Request Form” which we have prepared.

The right to restrict processing - You have the right to request that we restrict processing of your personal data, under certain conditions

The right to object to processing - You have the right to object to MATDAT’s processing of your personal data, under certain conditions

The right to data portability - You have the right to request that we transfer the data that we have collected to another organization, or directly to you, under certain conditions.

8.1. What are Cookies and how do we use them

9. CHANGES TO THIS PRIVACY POLICY

We may modify this Privacy Policy at any time and without prior notice. Such modified Privacy Policy shall be effective immediately upon their posting to the Services and will apply on a going-forward basis, unless stated otherwise in a notice to you. Such notice to you may be given by any means, including without limitation by sending an email and/or providing a notice through or on our Services. It is your responsibility to check this Privacy Policy and other policies for updates periodically and particularly prior to any use of our Services. If you do not agree to, or can not comply with, the modified Privacy Policy, your sole recourse shall be to stop accessing and using the Services.
